Operation Blue Ltd (OpBlue) may change or modify these terms and conditions at any time and you agree to be bound by these terms and conditions as changed or modified. Notice of any changes or modifications will be provided by publishing the revised terms and conditions on this website only and separate notification will not be given to you individually.

Tax deductible donation

Any donation over $2.00 (AUD) is tax deductible. Please email hello@opblue.org for a tax-deductible receipt.

Marketing

OpBlue uses images, videos and other marketing collateral in its digital and print media. Any intellectual property rights in these materials belongs to OpBlue and must not be used or reproduced in any way without OpBlue’s express written consent.

OpBlue respects the privacy of its clients and will not use any images or video footage of clients unless they have consented to such use.

Use of this website is governed by these terms and conditions and the Privacy Policy found on this website.

All donation pricing and transactions on this website are stated in Australian Dollars (AUD) and are secured using Secure Socket Layer (SSL) encryption technology.

By completing a donation you certify that:

1.     you accept the Terms & Conditions and the Privacy Policy,

2.     you approve us collecting your information, and understand you can cease communication, or access and change your personal information by emailing hello@opblue.org

We only use your information to process your donations and communicate with you about our charitable objectives.

Donations by individuals can be made in the form of one-off donations, regular gifts or bequests. OpBlue will determine where the funds are directed within its services. If a donation is designated to a specific project, OpBlue will use reasonable endeavours to direct that donation to the designated project but is not obligated to comply with such requests. Donations of gifts in kind will also be directed as determined by OpBlue.

Online donations

This website is enabled for online donations using a secure donation server. However, despite the security on the website, you should be aware that there are risks in transferring information across the Internet.

We record on our fundraising database the donor's name, address, email, telephone, and amount donated. Our fundraising database is protected by secure user IDs and passwords, to help protect it from misuse, unauthorised access, modification or disclosure. For more details on the collection and use of donor data, please see our Privacy Policy.

Refunds

OpBlue accepts all donations in good faith, including monthly gifts to our OpEducation sponsor a child program. Whilst we understand entirely that everyone has different preferences regarding donations and that sometimes it is not convenient to give, we will not refund a donation that has been knowingly and voluntarily given to us.

·      We will refund if there is evidence that an error was made by OpBlue

·      We will refund if there is evidence that a supporter has requested a regular debit cancellation 10 days prior to the debit date, however the debits have continued

·      We may refund if there are exceptional circumstances for example evidence of supporter vulnerability

Should an error in the donation amount be detected and a request for refund made after 30 days have expired, OpBlue regrets that we are unable to issue a refund.

OpBlue is a non-profit charity organisation and we reserve the right to deduct any bank or transaction charges for any refund processed onto the supporter.

To seek a donation refund you must contact OpBlue within 14 days of receipt by email at hello@opblue.org. OpBlue thoroughly considers all requests for a refund and will ensure that genuine errors are corrected, however we are under no obligation to give refunds and the decisions on refunds will be at OpBlue’s discretion. If you would like to request a refund please provide details of how you made the donation, the amount, the date and the circumstances justifying your request.

If a donation is refunded, the associated tax receipt is no longer valid and should be securely destroyed. Please note it is your responsibility to submit correct receipts to the ATO (Australia Taxation Office).

Authority to fundraise

Regulation and best practice in Australia dictate that any person or organisation fundraising must have an ‘authority to fundraise’. The Community Fundraiser is not authorised to use OpBlue as its beneficiary charity until it has received an authorisation letter from OpBlue.

The ‘authority to fundraise’ will be sent by OpBlue after:

·      we have received a written and signed application from the Community Fundraiser;

·      we are satisfied that the fundraiser/event will produce a reasonable return after expenses have been deducted;

·      we are satisfied that the fundraising activity aligns to the aims and values of OpBlue

·      we are satisfied the fundraising activity is not high risk.

The event/fundraiser must meet the requirements of relevant State and Territory laws and regulations. The information given to OpBlue must be available to regulatory authorities on request. OpBlue does not provide legal advice regarding compliance with these laws and regulations.

OpBlue is unable to provide public liability insurance cover to Community Fundraisers. OpBlue accepts no liability for personal injury, property damage or death arising in any manner from a fundraiser’s activity. Community Fundraisers must make sure that they take out an insurance policy which covers any risk associated with their fundraising activity or event.

The financial aspects of fundraising, raffles, record keeping and management of the fundraiser/event are entirely the responsibility of the Community Fundraiser and the Community Fundraiser must comply with the relevant State or Territory laws and regulations.

Using the OpBlue name and logo

All material with which the OpBlue name and logo is to be associated must first be approved by OpBlue.

Any material, pamphlets, brochures or products must be submitted to OpBlue for approval before a request to use the logo will be granted. All printed material including media releases must be forwarded to OpBlue for approval prior to being printed or circulated.

OpEducation Sponsorship Program

The Donation Debit Services Agreement governs any agreement by you to provide recurring donations to OpBlue.

To cancel recurring donations, notification is required at least 5 business days prior to the next scheduled payment date to effect any cancellation.

  1. OpBlue takes our responsibility to the children in our programs very seriously, and we strive to always provide safe environments for the children and young people to learn and grow. We act in the best interests of children and young people as our primary consideration. By completing this form, you are committing to support our Child Protection Policy.

  2. By completing this form, you are agreeing to sponsor Kenyan children with a monthly donation. This sponsorship may provide support to multiple children in greatest need.

  3. The funds from your sponsorship are used to provide an education to child ren, and support the OpEducation project in Kenya, Africa.

  4. Your personal information will be collected, used and disclosed by OpBlue in accordance with our Privacy Policy.

  5. Your donation is tax deductible. Please email hello@opblue.org for a tax-deductible receipt.

Direct Debit Service Agreement

This direct debit service agreement explains what your obligations are when undertaking a direct debit arrangement with OpBlue. It also sets out what our obligations are to you. It replaces entirely any previous agreement you may have had with us.

If you give your request via the internet, you acknowledge the inherent risks of doing so and that you are responsible for keeping your passwords, user IDs, etc. safe. For information about how we keep your information safe online when you use our website, please refer to our website terms of use.

Debiting your account

By making a direct debit request you authorise us to arrange for funds to be debited from your nominated account with your financial institution.

We will only arrange for funds to be debited from your account as authorised by you.

Funds will be debited from your account on the nominated day, except for certain months where the nominated day i.e. the 29th, 30th or 31st does not occur or the day for debiting your account falls on a weekend or public holiday. In such cases your account may be debited on the next business day. If you are not sure about which day your account is debited you should ask your financial institution.

Your obligations

It is your responsibility to make sure that there are sufficient clear funds available in your account.

If there are insufficient clear funds in your account to meet a debit payment:

·      you may be charged a fee and/or interest by your financial institution;

·      arrange for the debit payment to be made by another method or arrange for sufficient clear funds to be in your account by an agreed time so that we can process the debit payment.

·      You should regularly check your account statement to verify that the amounts debited from your account are correct.

Changing the agreement

We may change any details of this agreement or your direct debit request (such as amount or frequency) at any time by giving you at least 14 days' written notice.

You may change, stop or defer a payment or end this agreement by providing us with at least 5 days' notice or arrange it through your financial institution, which is required to act promptly on your instructions.

Note: your financial institution may only change our agreement by advising us of your new account details.

If there is a problem.

If you believe that there has been an error in debiting your account, please contact us directly and confirm in writing as soon as possible so that we can resolve your query quickly.

Alternatively, you can take it up directly with your financial institution.

If we conclude that your account has been incorrectly debited we will arrange for your financial institution to adjust your account (including interest and charges) accordingly. We will also notify you in writing of the amount by which your account has been adjusted.

If we conclude that your account has been correctly debited we will respond to your query by providing you with reasons and supporting evidence in writing.

Your information

Information that you can provide to us will be used to enable us to process your request and for other purposes explained in our Privacy Policy (you can also request a copy by emailing hello@opblue.org), or as the law permits. We don't rent, sell or exchange information we hold.
